RGS Performance is a registered Business Name of Robert Sidaway PTY LTD, Australian Business Number 60 140 051 805.
The Customer refers to anybody accessing this website via www.rgsperformance.au, www.rgsperformance.com.au, or www.rgsperformance.com.
By accessing this website The Customer agrees to the following.
Warranty, Returns and Cancellations
I stand behind my experience and the quality of the parts that I sell.
Parts received broken or defective must be advised within five business days of your order being delivered.
RGS Performance warranties all parts sold for twelve months from the date of your purchase. If a manufacturer's warranty extends beyond 12 months then the benefit of this warranty will be extended to the customer in accordance with the manufacturer's terms, policies, and procedures. If you have any questions regarding the warranty period of specific parts please contact me prior to completing your purchase. Please notify RGS Performance of any suspected warranty failures immediately.
Parts must be returned for assessment before any warranty claim can be accepted. Parts being returned for warranty assesment must be lodged with a carrier for return to RGS Performance, and consignment details provided to RGS Performance, within five business days of RGS Performance being notified of the suspected fault.
Parts are to be installed by a suitably qualified and experienced person(s) using the tools and observing the procedures outlined in the Nissan Factory Service Manual (FSM). RGS Performance takes no responsibility for failures of parts where these procedures have not been adhered to by the person(s) installing the parts.
Returns will not be accepted for change of mind or incorrectly ordered parts. Please choose carefully and if in doubt please get in touch prior to ordering.
Store credit will be applied to any cancellations received before your order is dispatched. A 20% restocking fee applies.
RGS Performance shall not be liable for any lost profits, lost savings, loss of reputation, loss of goodwill, any kind of commercial or economic loss, indirect, incidental, punitive, special, or consequential damages arising out of or in connection with the agreement of the sale of any products or services by RGS Performance or the use thereof whether or not such damages are based on tort, warranty, contract or any other legal theory – even if RGS Performance has been advised, or is aware, of the possibility of such damages.
Shipping & Deliveries - How Your Order Will Get To You
Free delivery, where specified, applies to metropolitan areas only. If your item can be carried by Australia Post then free delivery will also apply to rural areas, however items that are too large for Australia Post and may require a specialist courier service may incur additional charges. You will be notified if this is the case, and given the opportunity to cancel your order without penalty if you do not wish to proceed with the additional delivery charge.
Your order will be shipped via Australia Post parcel post, Aramex couriers, or Sendle network of couriers depending on the size, type, and destination for your order. Please make sure that you understand the terms of carriage offered by these providers and contact me if you have any additional requirements. If you have any specific requirements pertaining to the delivery of your order these must be noted on your order at the time of placing your order and may incur an additional fee. RGS Performance reserves the right to use an alternative freight provider not detailed above at any time and without further notice to the Customer. RGS Performance offers no guarantees, insurance, warranties or assurances with respect to goods in transit beyond those explicitly provided by the carrier.
By placing an order with RGS Performance either via the web store or by other means The Customer agrees that they provide Authority To Leave their delivery at the nominated delivery address without a signature being obtained. If a signature on delivery service is required this must be selected at checkout.
All care is taken when packaging your items but RGS Performance takes no responsibility for loss or damage sustained in transit. The liability of RGS Performance shall end once your order has been consigned for delivery to you.
I do not offer free shipping for International orders. If you are ordering from outside of Australia you will be invoiced for international shipping after checkout. I do not have a shop front for pickup.
Your purchase of goods or services will be subject to certain laws including, without limitation, the Australian Consumer Law. The Australian Consumer Law provides you with certain rights that cannot be excluded, including that goods and services must be of acceptable quality, reasonably fit for the purpose that RGS Performance represents they will be fit for, and that my responsibilities are discharged with appropriate care and diligence. Nothing in these Terms and Conditions shall be read or applied so as to exclude, restrict or modify or have the effect of excluding, restricting or modifying any condition, warranty, guarantee, right or remedy implied by law which cannot by law be excluded, restricted or modified.
